Warranty Information
Tampa Bay Paddle Company offers a limited lifetime warranty within the USA for the hull of every new kayak and stand-up paddle board we sell. This warranty covers manufacturing defects that affect the performance of the vessel.
Damage incurred during shipping is not covered by this warranty. For information related to shipping damage, please click here.
This warranty does not cover any damage as a result of the following:
- Any modifications made to the vessel
- Excessive exposure to sunlight and/or heat
- Any accident due to negligence or improper use or handling
- Towing by any powered vessel
- Damages caused by normal wear and tear (i.e. abrasions, chipping, or color fading)
- Any commercial use - rental or classes included
- Cosmetic defects
- Product is determined to have been used for any activity other than an activity that is customary for this type of product
- Claim is made by anyone other than the original purchaser
- Product has not been registered within the required time period
- Aftermarket wheel systems
- Unsecured transport of vessel
Items which may be included with the vessel, such as seats, paddles, and pedal drives, are covered for one year from original purchase date.
Additional Warranty Service Details
Claims must be submitted using our online form and must contain all required details. Do not dispose of any vessel submitted for warranty repair/replacement until confirmed by Tampa Bay Paddle Company.
For safety reasons, all vessels replaced by warranty must be decommissioned. Do not complete decommissioning steps until directed to do so. Video evidence is required of the decommissioning process. The decommissioning steps will be provided once your warranty claim has been approved. For covered warranty repair or replacement, you will be responsible for paying any applicable shipping costs. Customers are provided the option to drop-off and/or pick-up the product from our warehouse location. Vessel may be replaced with a comparable product.
Customer should determine the suitability of the products for the intended use prior to using the products and assumes all risk and liability in connection therewith. WE SHALL NOT BE LIABLE TO YOU FOR ANY OTHER OBLIGATIONS OR LIABILITIES, INCLUDING, BUT NOT LIMITED TO, OBLIGATIONS OR LIABILITIES ARISING OUT OF BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORT OR ANY THEORY OF STRICT LIABILITY, WITH RESPECT TO THE PRODUCTS OR TAMPA BAY PADDLE COMPANY'S ACTS OR OMISSIONS OR OTHERWISE. Any assistance provided by Tampa Bay Paddle Company to you outside of the terms, limitations, or exclusions of this warranty will not constitute a waiver of the terms, limitations, or exclusions of this limited warranty, nor will such assistance extend or revive the warranty. We will not reimburse you for any expenses incurred in repairing, correcting, or replacing any defective products, except those incurred with our prior written permission.
Accessories Warranty
All accessories purchased from Tampa Bay Paddle Company come with a one-year warranty that covers manufacturing defects. This warranty does not cover damages caused by normal wear and tear, misuse, neglect, accidents, or modifications made to the accessory.
All warranties are non-transferable. Proof of purchase is required. This warranty does not cover products sold 'As-is' or demonstration models.
LIMITATION ON DAMAGES
IN NO EVENT SHALL WE BE LIABLE FOR INCIDENTAL, COMPENSATORY, PUNITIVE, CONSEQUENTIAL, INDIRECT, SPECIAL OR OTHER DAMAGES. OUR AGGREGATE LIABILITY WITH RESPECT TO A DEFECTIVE PRODUCT SHALL BE LIMITED TO AN AMOUNT EQUAL TO YOUR ORIGINAL PURCHASE PRICE PAID FOR THAT DEFECTIVE PRODUCT. Some states do not allow the exclusion or limitation of incidental and consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, which may vary from state to state.
